No, the law protects those with physical or mental impairment that substantially limits one or more major life activities. Under 504, schools must make appropriate accommodations to eliminate barriers to the students’ participation in school and school activities. Implementation of Section 504 provides disabled students with the same access to educational opportunities provided to their non-disabled peers and supports them in achieving positive health and educational outcomes.
Example accommodations:Reducing the number of homework problems without reducing the level or contentGiving the student a quiet place to work Providing clear and simple directionsGiving tests in a quiet place, breaking tests into small pieces, modifying test format, and/or providing extra timeUsing audio recording devices or giving the student a copy of notesUsing positive behavioral intervention techniques
If ADHD symptoms 'substantially limit' a child’s ability to learn, he or she is entitled to Section 504 services.
It is suggested that three year IEP’s be avoided because it is difficult to determine a student’s unique needs even when done at regular intervals.
