Samuels v. Chertoff, 550 F.3d 252 (2d Cir. 2008)Mr. Samuels applied for a green card with a waiver of his criminal history. Mr. Samuels’ case was initially denied because the Board of Immigration Appeals concluded that the regulations required him to show “exceptional and extremely unusual hardship” to his family. I won Mr. Samuels a new hearing before an immigration judge because the regulations permit other factors besides hardship to be considered, which were not considered by the Board.

The Federal Circuit is unique among the courts of appeals as it is the only court that has its jurisdiction based wholly upon subject matter rather than geographic location. The Federal Circuit is an appellate court with jurisdiction generally given in 28 U.S.C.

Court of Appeals

The court hears certain appeals from all of the United States District Courts, appeals from certain administrative agencies, and appeals arising under certain statutes. Among other things, the Federal Circuit has exclusive jurisdiction over appeals
