The Founding Fathers wanted to make sure that justice was brought without abuse. The King of England would have people publicly shamed by having five slashes or more. Even had them hung or be headed to control everyone by showing the consequences of what would happen if someone would disobeyed the king.

In Massachusetts 1751 the British Empire strictly enforced the Acts of Trade, allowing officers to enter and search priviate homes. Which many colonist's privacy was violded, in 1761 James Otis spoke about these searches "One of the most essential branches of English liberty is the freedom of one's house. A man's house is his castle; and whilst he is quiet, he is as well guarded as a prince in his castle." The Founding Fathers protected the rights of individuals and limited the government power.

During, the time when people immigrated to the U.S, they all desired a greater religious freedom. The Founding Fathers wanted to make sure the religious freedoms were protected and also that no american could be forced into any religion. In the Revolution, the Stamp Act, petition and protest against the taxes a were being ingored by the King of England even the Parilament which angered many colonist. The Intolerate Acts prevented town gatherings which the Founding Fathers gave citizens the freedom of assembly. Also, citizens have the right to start a petition when they do not like something. If colonist talked badly of the king they were slaughtered as in the first amendment grants citizens the freedom of speech and press.

The eighth amendment allows a criminal to be brought to justice but, without brutal punishments to occur.
